Any single parents that have traveled overseas for a vacation from USA with their child?

We have heard that immigration may ask for a notorized letter from the other parent granting permission for the child to travel. Has anyone had any experience with this and been asked to produce such a letter? If so, what country did you travel to. Australia is our destination. The father is a mean, angry and resentful person (remarried with other children, by the way) but just wants to make things difficult and won't sign this letter. The child that is traveling does have a passport. The mother will also be carrying the child's birth certificate proving that she is the mother, she will be carying ID, and she will also be carrying court orders stating that she has primary physical custody of the child.

Our fear is that immigration will ask for this letter from the father and deny departure from the US, completely ruining the 2 week vacation we have planned.

We have employed a lawyer to try and get this letter but the father still refuses to sign.
