Maternity Leave in California and accumulated vacation & sick leave.?

Hello I found a website where a woman living in California broke down maternity leave in 3 parts that was VERY helpful and understandable. ( http://www.associatedcontent.com/article/69587/maternity_leave_in_california_understand.html) My question is after you are approved to use the SDI & Paid Family leave, are you able to use accumlated vacation and sick leave time AFTER you have used the required leave that the state offers?
According to my employer (I work for a College District - so it's a state job) I can use my vacation and sick leave...we get 12 days of sick leave at the start of the fiscal year, and then we get 88 days of 1/2 pay or 88 1/2 day paid sick leaves...if that makes any sense...and according to my union rep I can use all those days.

1. I don't know, I live in a different country, but my sister in law took her 12 weeks, then took her 2 week paid vacation, and then quit her job :P

I don't know about sick leave time, but you should be able to take your vacation time. After all, it is YOUR vacaction time.

2. As long as your leave is medically necessary, you can use your sick leave. Whether or not you can use your annual leave is up to your employer. Chances are most employers that I've worked for have allowed employees to exhaust all types of leave before returning to work. My husband's employer also gave him the option of taking even more time only it would have been leave without pay.

3. Yes, I belive so, or you can jsut get a lump sum from your emplyer before you go on maternity leave

4. it depends on the employer, some employer don't allow it, but in california, you are entitled 3 months of maternity leave and the state is able to pay 90% of your salary by applying for your "Bonding" pay with the state.

5. I live in Ca too. You have to use a week of your sick leave no matter what... just because the state benefits don't kick in until after 1 week. Then, you can use up your sick leave and vacation time to spread out the rest of time..

so to break it down for you. you get 1 month off before your due date. 6 weeks to have your baby. another 6 weeks bonding time. and then whatever is left of your vacation... they have to let you take up to 6 mos off and your job is safe. Anything after that and you could risk losing your job if they really need someone to fill the position or if they just want to get rid of you.

Your husband will get time off too, but it's way more complicated and not as good of a deal.
